Welcome to Bush Walker Adventures. By booking a tour package with us, you agree to the following terms and conditions. These terms apply to all tour services provided by Bush Walker Adventures, including customized and pre-designed packages.

1. Definitions

● Client: The person or entity purchasing the tour package.
● Bush Walker Adventures: The service provider facilitating the tour package.
● Tour Package: Includes transport, accommodation, activities, and other
agreed services as specified in the itinerary

2. Booking and Payment

A. Group/FIT’s Booking Terms

● A deposit of 25% of the tour price is required upon confirmation if the
booking is made more than 90 days before the departure date.
● The balance of payment must be made 8 weeks prior to departure or on
the date stipulated on the invoice.
● If the reservation is made within 60 days of the departure date, full
payment for the tour is required.

B. Payment Methods

● Payments can be made via bank transfer, credit card, or M-Pesa.

C. Tour Prices

Tour prices are based on current rates of exchange and are subject to variation
due to:
● Government actions or new regulations
● Adjustments in Value Added Tax (VAT)
● Fluctuations in exchange rates
● Increases in transportation costs, fuel prices, park fees, or hotel rates

3. Cancellation and Refund Policy

A. Refunds for Unused Services

Refunds for unused services are subject to the cancellation and amendment
policies below.

B. Cancellation & Amendments by Passengers

The following penalties apply for cancellations:
● More than 90 days before departure: 10% of the total tour price
● 90 – 45 days before departure: 35% of the total tour price
● 45 – 29 days before departure: 50% of the total tour price
● 30 – 15 days before departure: 70% of the total tour price
● Less than 15 days before departure: 100% of the total tour price

4. Changes to Itinerary

● Bush Walker Adventures reserves the right to modify the itinerary due to
weather conditions, safety concerns, or other unforeseen events.
● Significant changes will be communicated in advance when possible

5. Client Responsibilities

● Ensure all travel documents (e.g., passports, visas) are valid and meet the
destination requirements.
● Inform Bush Walker Adventures of any health conditions, dietary
restrictions, or special needs at the time of booking.
● Adhere to local laws and respect the environment and local communities
during the tour.

6. Liability and Insurance

A. Bush Walker Adventures’ Liability

● Bush Walker Adventures is not responsible for delays, injuries, or losses
caused by third-party providers, weather, or other factors beyond our
control.

B. Client’s Insurance

● Clients must have comprehensive travel insurance covering cancellations,
medical expenses, accidents, and personal belongings.

7. Force Majeure

Bush Walker Adventures is not liable for failure to fulfill obligations due to even
beyond our control, including natural disasters, strikes, or government restrictions.

8. Dispute Resolution

● Any disputes will first be resolved through amicable negotiation.
unresolved, disputes will be subject to Kenyan law and handled by
arbitration or courts in Kenya.

9. Use of Images and Testimonials

● By participating in the tour, you grant Bush Walker Adventures permission
to use photos, videos, or testimonials for marketing purposes unless
explicitly stated otherwise in writing.
